Abengoa Bioenergy, which owns an ethanol plant in Colwich, is suing a contractor over a 2009 industrial accident.
In a suit filed last week, Abengoa said that it seeks more than $3.5 million from Faber Burner Co. of Lock Haven, Pa.
Abengoa bought a burner and control system from Faber to be used in ethanol production.
In April 2009, Faber technicians serviced the system. The day after they left, on April 18, the boiler controlled by the burner system "experienced a catastrophic failure as a result of an explosion in the fire box."

NEW YORK (AP) — Stock indexes are lower at midday, putting the Dow Jones industrial average on track for its first weekly loss following two weeks of gains.
Both the Dow and Nasdaq are trading below milestones hit earlier this week. The Dow closed above 13,000 Tuesday for the first time since May 19, 2008. The Nasdaq composite index broke the 3,000 level Wednesday for the first time since 2001.

BRUSSELS (AP) — The leaders of 25 European countries today signed a new treaty designed to limit government overspending.
By backing the so-called the fiscal compact, the leaders hope to achieve closer political and economic integration and longer-term confidence in Europe's finances. But the economic reality in the region — record unemployment and a slide back into recession — suggests the leaders need to reconsider their focus on austerity and seek ways to boost growth.
