    Changes To the No Win No Fee System

    The government, in the form of Lord Justice Jackson, is proposing to introduce changes to the way in which the fees and compensation involved in personal injury cases are charged and rewarded . Having studied the proposed Green Paper, many different parties have come forward with opinions on the matter, with the main cause for concern being that the changes may result in an overall reduction in the amount of compensation which finally makes its’ way to the claimant in question.

    The main change being proposed is to the so called ‘success fee’ which a lawyer can charge after winning a case under what is commonly known as the ‘No Win No Fee’ system. Under this system, claims are encouraged by the fact that, if a client loses their case, they will not be liable to pay the costs of the other side and, if they win, they will be able to keep everything they’ve been rewarded, with any fees for the successful solicitor being claimed from the ‘losing’ side.  In the unfortunate event of a claimant losing a case, any fees liable will be covered by insurance taken out at the beginning of the process, and, in winning cases, these premiums will, again, be covered by the losing side. The key advantage of this system is that it opens up the possibility of claiming compensation to everyone, irrespective of whether they have the money to pay for legal help up front.  What’s more, because the solicitors’ fees are dependent upon the claim being successful, personal injury firms are only likely to take on cases which they feel certain of being able to win.
