International human rights organisation Amnesty International has warned that proposed reforms to the law on conditional fee agreements will put victims of human rights’ abuses at a severe disadvantage, and make many claims “financially unviable”.
Amnesty issued their warning by writing to every member of the House of Lords, urging them to vote against another of justice secretary Ken Clarke’s plans to radically reform UK justice funding.
Conditional fee agreements are more commonly recognised as “no win no fee” agreements , which are most commonly used by personal injury solicitors. Conditional fee agreements have been viable in the UK since 1995, and they allow clients with a claim to enlist a solicitor to help them, without the risk of incurring high legal fees in the event of a loss.
As the law on conditional fees stands, a no win no fee solicitor will claim his or her legal fees from the opposing side, in the event of a victory. However, under the new plans, solicitors and law firms will receive a share of the clients winnings, which could greatly cut down the amount of compensation that a successful client will see.
