A victim of the post-election violence whose two daughters were burnt to death in Kibera has sued the government seeking compensation for loss of a livelihood.
Florence Amunga Omukanda is seeking compensation for the loss, pain and suffering that she underwent in aftermath of the December 2007 general election. She says she sustained 80 per cent burns and lost her two children aged eight and 3 weeks when unknown assailants attacked her house in Kibera Laini Saba on December 30, 2007 following the outcome of the disputed presidential poll.
Omukanda says she and her two daughters were sleeping when unknown assailants locked the house from outside and torched it. She says her property including household goods were destroyed in the fire. The woman says despite having reported the matter to the authorities, the government had failed to help her. She says well wishers paid more than Sh100,000 for her treatment at the Kenyatta National Hospital.
She accuses the government of failing to protect her and her property making her victim of the violence and wants the court to rule that her rights to property were violated. She is seeking a declaration that her rights to protection of property as enshrined and as contemplated in article 40 of the constitution , article 14 of the African Charter on Human and people Rights and article 17 of the Universal declaration of human rights were violated by the negligent conduct of the police commissioner and the Internal security minister.
