The case arose out of a 2007 alligator attack on an 83-year-old woman on the grounds of The Landings, an exclusive golf and residential resort on Skidaway Island near Savannah.
The woman, Gwyneth S. Williams, died from her injuries. In 2008 her heirs sued The Landings Association and The Landings Club seeking damages for her wrongful death, The Atlanta Journal-Constitution reported Monday.
Attorneys for the landowners responded that under the doctrine of "ferae naturae," (wild animals), a landowner is not responsible for harm caused by an indigenous free wild animal on the owner's land.
Attorneys also argued because there had been no previous alligator attacks at The Landings, there was no evidence to show the attack on Williams was foreseeable.
Although no warnings about alligators were posted at lagoons on the property, The Landings Association did warn residents in publications and on its Web site that alligators were present and could be extremely dangerous, attorneys for The Landings said.
